Family Law Practice Areas

Divorce

 

A marriage is a legal contractual relationship. Divorce is the process of breaking that legal contract of marriage when parties no longer wish to have this relationship and be bound to their marital contract. Divorces can be contested or uncontested. In either case, documents have to be filed in court to petition for divorce. 

Some divorce cases can be resolved without the need to litigate issues before a Judge if the parties are willing to cooperate with each other.  However, if the parties can't agree and come to terms, there’s a chance that the issues might have to be heard in court and be decided by a Judge. If so, like other forms of civil litigation, divorce cases might involve the process of discovery through documents like Interrogatories, Depositions, and Mediation. 

Alimony

In Alimony cases, it's critically important to make sure that the court uses accurate and complete information in order to arrive at the correct amount of support.

Factors such as the length of the marriage, ability to pay, need to receive income, levels of jointly-accumulated debt, the age of the parties and whether they can work, and whether there was misconduct by either party play a key role in determining the amounts awarded.

 

Similar to Child Support matters, we work to ensure that our client's award is fair by showing the court the full financial picture of both parties. 

Division of Marital and Non-Marital Assets

The State of Florida has its own guidelines for how to divide assets (separated as marital and non-marital assets) and debts in a divorce. In general, the courts looks to make an equitable division of the assets.

 

This doesn’t necessarily mean dividing things equally. The court can look at things like the parties’ contributions to the marriage, the length of the marriage, the needs of each party after the divorce, and many other factors. Misconduct such as infidelity or domestic abuse can also play into the court’s decision.

Child Support

The goal of child support is to provide children whose parents are separated the same financial resources that they might have if both parents were together. Child support amounts are largely determined by a formula. Most formulas consider each parent’s income, tax deductions, the child’s health insurance expenses, child care needs and other factors.

In Child Support matters, we work to ensure that our client's child support awards are fair by showing the court the full financial picture of both parties. We also review the calculations of the court to make sure that there aren’t any errors that could result in an inaccurate  award..

Child Custody and Shared Parental Responsibility

Shared Parental Responsibility is the shared

responsibility of both parents working together to raise and parent a child. Each individual keeps full parental rights, and they share the parenting workload. The Courts today want to get away from awarding"custody" of a child, but when one parent is unable to parent their child, the other can request full custody of the child. 

In Florida, Shared Parental Responsibility and parenting time are based on the best interests of the child. The court considers factors like which parent has the greater bond with the child, whether each parent has a stable home, and whether either parent has a criminal record or substance abuse issues. If parents agree on a plan, the court usually follows the agreement. If the parents can’t agree, family lawyers present the evidence  about the child’s best interest to the court for the court to make a decision.
