What is Premises Liability Law? (Slip & Falls, Trip & Falls)
Premises Liability law is a type of Personal Injury law in which an injury was caused by some type of unsafe or defective condition on someone's property due to the property owner's failure to use reasonable care in connection with the property. In this area of law, like in many others, case law determines whether you have a good claim or case. In previously litigated cases, the courts have determined certain elements need to be present in order to be successful bringing a claim or case against a property or premises owner.
Premises Liability claims or cases always have a percentage of personal responsibility built in. In other words, you will be partially responsible for your fall. Factors such as what you were wearing, what you had in your hands, your weight, and your age at the time of the fall play into the argument for whether the property owner may be liable for your fall and may owe you monetary compensation for your injuries and damages.
